Your Booking
Your booking is made with
Luxuria Villas Limited, a company registered in England and Wales number
6150938. Luxuria Villas Limited act as agents for owners of individual
villas or their appointed management companies. The client shall mean
the lead passenger detailed on the booking form and who accepts these
terms and conditions on behalf of the booking party.
Prices
Prices are shown in £
sterling and are correct at the time of viewing, although we reserve the
right for amendments or omissions to these prices, which will become
effective immediately for all bookings taken after the website has been
updated. Prices will be liable to change due to currency fluctuation. A
US Dollar price for each property will be available that will remain
fixed and clients can pay in US Dollars into Luxuria Villas Limited UK
based US Dollar account. Prices are based on the rental of the property
on a nightly rate unless stated and the price will be based on the
corresponding maximum occupancy for a quoted rate. A minimum stay of 5
nights is required during low season and a minimum stay of 7 nights is
required during high season. During the period of December and January a
minimum stay of 14 nights is required and special rates will apply.
Deposits and Payments
Unless otherwise stated a
deposit of 25% will be required to confirm a booking. The remaining 75%
of the cost of the booking will be required 10 weeks prior to departure
and if not received by the balance due date on your confirmation/invoice
we reserve the right to cancel the booking and apply any applicable
cancellation charges. An invoice detailing deposits paid and monies due
will be sent upon receipt of a completed Booking Form (See 'Booking
Form'). The appropriate documentation for your booking, including your
accommodation voucher, instructions and any appropriate directions will
be sent out 2 weeks prior to your departure. Payments can be made by
cheque (payable to Luxuria Villas Ltd) or by credit or debit card.
Credit Card payments will be subject to a 2.5% surcharge. Debit Card
payments will not subject to any surcharges.

Booking Form
We require a fully completed
booking form for ALL bookings. This booking form should be
completed as soon as possible after the initial payment has been made
(in the case of booking made within 10 weeks of departure this needs to
be as soon as possible after the full payment has been made). Booking
forms can be completed using the paper copy sent with a brochure or via
the website booking form. By checking the acceptance of these terms and
conditions in an online booking form this will act as your electronic
signature. Luxuria Villas Limited reserves the right to cancel a booking
if a booking form is not received. Accommodation is reserved exclusively
for those persons named on the booking form. No other persons are
permitted to stay in the property without the written permission of
Luxuria Villas Limited and the receipt of such payment. Where clients
have been given a rate that involves the use of a limited number of
bedrooms in a property then clients should be aware that access may not
be granted to the additional bedrooms. Access to all communal areas will
be allowed. Over occupancy, or occupancy above that stated on the
booking form will result in penalty charges and may be in contravention
of local legislation.
Cancellations
Should you wish to cancel
your booking the person identified as the lead passenger and who has
signed the booking form must make the cancellation in writing. The
booking will be subject to the following scale of cancellation charges,
based on the day Luxuria Villas Limited receive the written
cancellation:

Security Deposits
All our properties are
finished to the highest standards with many having expensive fixtures
and fittings and as a result we will require a £500 security deposit on
every booking taken. This security deposit will be due with the balance
payment 10 weeks prior to the property booking date. The property should
be vacated with all fixtures and furnishings in the same condition as at
the start of the rental (fair wear and tear expected). The local
management company should be informed of any damage caused to the
property or its contents, with the client undertaking to pay for any
damages. Providing no damage is done and/or there are no outstanding
bills we will return this deposit to you within a maximum of 4 weeks
from your departure date, although we will always aim to return security
deposits within a shorter timeframe.
Arrival at your
Property
Unless otherwise stated your property will be
available after 15:00 hours on the day of your arrival and to ensure
that the accommodation can be prepared for new guests the property must
be vacated by 12:00 hours. Please be aware of these times in conjunction
with flight arrangements. All possible will be done to assist clients
with arrival and departure arrangements outside these times, including
the appropriate storage of luggage, however we reserve the right to
impose supplementary charges if the property is not vacated by the time
stated.
Passports/Visas
Luxuria Villas Limited, or
any of its associated companies, cannot accept responsibility for the
failure to carry valid passports, visas, licences or any other necessary
documentation.
Force Majeure
Except where expressively
stated in these booking conditions Luxuria Villas Limited cannot accept
any liability or pay any compensation where the performance of our
contractual obligations is prevented or effected by circumstances
amounting to force majeure. In these booking terms and conditions this
means any event which we, or the supplier of the service(s) in question
could not, even with all due care and attention, avoid. Such events may
include war or threat of war, civil strife, natural or nuclear disaster,
industrial dispute, terrorist activity, fire, adverse weather
conditions, unforeseen local building/roadwork's, unavoidable technical
problems with transport and all similar circumstances beyond our
control.
Website and Brochure
Accuracy
Luxuria Villas Limited takes
great care and attention in providing accurate and detailed information of
available properties however there may be times when facilities and
services which are not under our direct control may not be available. We
will endeavour to inform clients of any such changes, however these will
not in themselves allow you to cancel your booking without penalty. Luxuria Villas Limited act as agents for owners and management companies
and always try to maintain a minimum standard of furniture, decoration
and maintenance, though we cannot guarantee that any particular feature
will be available. Photographs are intended to give as accurate a
description as possible of the property and the resort, however Luxuria
Villas Limited cannot accept responsibility for any aspect of a picture
that may have changed or been removed, nor for any changes to aspects or
views since the photographs were taken or descriptions compiled.
Use of the Property
The Client may only use the
property for the purpose of a private holiday home residence. The Client
shall not sub-let or assign their rental of the property. Luxuria Villas
Limited reserves the right to terminate the use of a villa in the event
that, in the opinion of Luxuria Villas Limited or any of its associated
management companies believe that:

The guest or
his invitees behaves in a manner which constitutes a nuisance. |
| (ii) |
The
guest or his invitees behaves in a manner which in the opinion
of any of the
companies
involved is likely to cause damage to the property or any of the
fixtures or
fittings in that property. |
| (iii) |
The guest or
his invitees behaves in a manner which renders it impossible or
unreasonable to continue the provision of any of the services to
the villa or to the guest or his invitees |
| (iv) |
The guest or
his invitees behaves in any manner which is not consistent with
the fit and proper use of the villa. |
Our Responsibility to
You
We plan our property bookings
months in advance and occasionally properties are withdrawn by owners or
other circumstances make them unavailable or unsuitable. Fortunately
this is a very rare situation and we will advise you as soon as possible
and always endeavour to offer an alternative property of equal of higher
standard if we are forced to make changes to your booking. However, we
reserve the right to continue a booking if a property of equal or higher
standard is available, and subsequent cancellation will be subject to
cancellation penalties.
Building Work
Building and the resulting
noise and disturbance adjacent to any property featured may occur at any
time. We will always advise you of any such work that may in our opinion
affect your booking. We will endeavour to offer alternative
accommodation (with the client paying or receiving a refund in respect
to any difference). If we are unable to provide alternative
accommodation we will refund all monies paid. Unfortunately we have no
control over building work and due to its intermittent nature we are not
always aware when it may commence. We cannot be held liable for any
building work which commences after your arrival and/or of which neither
we or our management companies have prior knowledge and warning.
Complaints and Disputes
Luxuria Villas Limited
receives very few complaints but those which occur are normally settled
swiftly and amicably. If during the course of your stay you have any
reason for complaint of dissatisfaction, you must contact the local
management representative who will do there best to resolve the problem
on the spot. If they are unable to solve the problem to your
satisfaction please contact Luxuria Villas Limited at the UK office
within 48 hours of the problem arising and we will do everything
possible to resolve the problem. If, after your return, you are still
not satisfied you must notify us in writing within 2 weeks of your
return to settle your dispute. Failure to comply with the timescales
mentioned will deprive Luxuria Villas Limited of the opportunity to
rectify the problem and will void any compensation claims.
